Sexual assault charge stayed against former Swift Current teacher

A charge of sexual assault against a former Swift Current teacher has been stayed.

 

The accused, 52-year-old Klaus Froese, was scheduled to appear in Swift Current provincial court on Oct. 9 for a preliminary hearing.
“He was not in court nor was his counsel,” Senior Crown Prosecutor Stephen Kritzer said. “They were advised prior to court that the charges would be stayed.”
According to Kritzer, the Crown will constantly review any charge to ensure that it is always prosecutable.
“It happens that in this case just prior to running the preliminary hearing the file has now become unprosecutable,” he noted. “The problem with the case is that there would have been a legal impediment to getting a conviction.”
The staying of the charge means it will be held in abeyance for one year.
“At any time during that one year, the Crown can resurrect the charges by simply notifying the clerk’s office,” he said.
The Swift Current RCMP received a complaint of a sexual assault on Dec. 6, 2011, and began an investigation. It resulted in Froese’s arrest on Dec. 16.
His legal counsel entered a not guilty plea on his behalf during his third scheduled court appearance March 28.
Previously the court made an order to restrict the publication of any details that could identify the complainant, who is under the age of 18.
Froese was a teacher at OM Irwin School in Swift Current until shortly before the charge against him.
